How many lawyers use AI? Thirty per cent, said the ABA’s 2024 technology survey. Sixty-two, said the State Bar of Texas in 2026. Sixty-nine, said the 8am Legal Industry Report. Seventy-nine, said Clio. Ninety-four, said LexisNexis this month. Every one of those figures is correctly reported, and anyone who quotes one without its denominator will be corrected by the person in the room who read the report.

The most useful legal AI statistics of 2026 are therefore the gaps between the headlines. Nicole Black, author of the 8am report, explained the largest gap in August 2026: personal use jumped from 31% to 69% in a year while firm-level rollout stayed “closer to 41%”, so lawyers are “using generative AI off the books”. What follows is every credible figure with its survey, sample and date, with vendor surveys, academic trials and court databases kept apart.

Why the adoption numbers disagree

Every adoption number has a denominator. “Uses any AI in the firm” (Clio’s 79%) includes 34% who use it minimally and 21% partially; only a quarter used it widely or universally in the 2024 breakdown. “Personally uses general-purpose generative AI for work” (8am’s 69%) is an individual measure; “the organisation’s legal team uses generative AI” (Thomson Reuters’ 41% of firms) is institutional; “any AI for legal work” (LexisNexis’s 94%) is the loosest of all.

Three habits keep you honest: state the denominator in the sentence, give the fieldwork date (a 2025 survey published in 2026 describes 2025), and say who paid. LexisNexis, Clio and Wolters Kluwer sell what they measure, which makes the wording of the question worth reading.

Adoption by firm size, role and tool

Size is the strongest predictor after age. ILTA’s 2025 survey of 580 firms found 100% of firms with 700 or more attorneys using or exploring generative AI against 63% of firms with 50 or fewer; the tools in use were Microsoft 365 Copilot (68%), CoCounsel Core (36%), Westlaw AI-Assisted Research (34%), Harvey (33%) and Lexis+ AI (25%), but most deployments were pilots, including 71% of Harvey users, and only 8% had Copilot firm-wide (Law360 on ILTA). Texas found the same gradient: 87% at firms of 25 or more lawyers against 64% at smaller ones, and 87% among in-house counsel; of users, 63% use ChatGPT and Copilot rose from 31% to 44% in two years (State Bar of Texas).

Clio found Millennials and Gen X 5.6 times more likely than Baby Boomers to use AI widely, and the tool mix drifting to general chatbots: only 40% use a legal-specific solution, down from 58% in 2024, while nearly half use ChatGPT, Gemini, Claude or Perplexity (Clio). In-house, 87% of general counsel report generative AI use in their teams (FTI/Relativity, March 2026), but Axiom’s July 2026 survey of 528 legal leaders found only 7% had scaled beyond pilots. Time and money: 240 hours, $19,000 and a 4.2% rise in billable hours

Thomson Reuters’ Future of Professionals 2025 (2,275 responses, February to March 2025) reports that legal professionals expect to free up “nearly 240 hours per year, up from 200 in 2024”, about five hours a week, with “an average annual value of $19,000 per professional” (Thomson Reuters). In the same report, organisations with a visible AI strategy were 3.5 times as likely to see a return and 1.9 times as likely to be seeing revenue growth, but only 22% had one.

8am 2026: 38% save one to five hours a week, 14% six to ten, and 33% report better quality with no time saved (LawNext on 8am). Everlaw 2025 (299 e-discovery professionals): 42% save one to five hours. Wolters Kluwer 2026: 62% save 6% to 20% of weekly time. None of it has dented the hourly model: around 90% of US legal dollars still flow through hourly arrangements, billable hours rose 4.2% in the first half of 2026 against a 1.5% to 2% norm, and AI investment runs at roughly 0.25% of revenue. Hallucination rates by tool

The only pre-registered benchmark of the paid research platforms remains Stanford RegLab’s 2024 study of 202 queries (Stanford HAI). Its numbers have reached the Ninth Circuit, which quoted them in Lnu v. Blanche in June 2026 (and swapped the two vendors’ figures in the process), and its wording is “more than”, not a flat rate.

Two footnotes belong on any slide. Stanford’s typology matters more than its rates: 47% of Lexis errors were naive retrieval, 38% inapplicable authority, 61% of Westlaw errors reasoning errors despite correct documents; a “misgrounded” citation, a real case cited for a proposition it does not support, is the failure a citation checker will not catch. Sanctions: 2,039 decisions by country and party

Damien Charlotin’s AI Hallucination Cases database listed 2,039 court decisions involving hallucinated material on 12 September 2026. By country: USA 1,396, Canada 217, Australia 110, UK 69, Germany 11, Austria 2. By party: pro se litigants 1,173, lawyers 811, judges 32. Year by year, from the database’s own CSV: 16 decisions in 2023, 61 in 2024, 851 in 2025 and 1,111 in 2026 up to 12 September, peaking at 179 in March 2026. 368 entries carry a monetary penalty; where a tool is named it is overwhelmingly ChatGPT.

Who gets caught is as telling as how many. Stanford’s Riana Pfefferkorn analysed 114 US lawyer cases: 90% came from solo or 25-or-fewer-lawyer firms, solos alone being 50.4% of the firms involved, firms of 1,001-plus lawyers 1.6%. Penalties escalated from $5,000 jointly and severally in Mata v. Avianca (2023) to $15,000 per lawyer plus fees and double costs in the Sixth Circuit’s Whiting v. City of Athens (March 2026) and $110,204.38 in combined sanctions and fee-shifting against two lawyers in Couvrette v. Wisnovsky (D. Or., 2025-26). Training and policy gaps

These figures explain the sanctions figures. 8am 2026: 54% say their firm has provided no training on responsible AI use and has no plans to; 43% report no policy; 9% work under a written, enforced policy. Law360 Pulse 2025: roughly two-thirds of BigLaw attorneys were trained by their firm against 40% at midsize firms and under 15% at small firms. Texas 2026: 50% report no official policy, 67% support required CLE on the ethical use of AI, and only 9% are “extremely confident” evaluating AI-generated documents while 40% are “not at all” or “slightly” confident.

Thomson Reuters’ 2026 Future of Professionals adds the shadow-AI figure: 34% use unsanctioned tools, 41% lack access to professional-grade AI (Thomson Reuters). A policy is not a control: Butler Snow had a written AI policy from June 2023, and three of its partners were still disqualified in Johnson v. Dunn (July 2025). Pricing, revenue and what clients see

Adoption has outrun repricing. Clio’s 2026 solo and small-firm data, as reported by the NC Bar: 71% of solos and 75% of small firms have adopted AI, only 32% and 31% report a revenue increase, and 86% of solos and 78% of small firms have not adjusted pricing. Clio 2025: 36% say AI has had a positive influence on revenue, 69% among wide adopters; 45% of wide adopters changed pricing (26% raised prices, 11% cut them, 8% added an AI fee).

The market data says the same. Best Law Firms (4,852 firms): 58% say AI “has had no effect on billing practices”. LexisNexis September 2026: 55% believe firms will change billing because of AI, up from 40% in January 2025. From the buyer’s side, Axiom found 92% of in-house teams expect or are negotiating AI-related rate cuts, and few get them.

On the client side, corporate buyers want it and do not see it: 78% say AI-enabled quality improvements are very important or essential, 6% say most providers deliver them, and 32% have reconsidered or plan to reconsider firm relationships (Thomson Reuters Future of Professionals 2026). ACC/Everlaw (657 in-house professionals): 59% do not know whether their firms use generative AI on their matters. Consumers are cooler. Clio 2025: over a third would trust an AI-using lawyer less; 28% were directed by their AI to contact a lawyer; 12% were talked out of a claim. Clio UK 2026: 81% of firms say they disclose AI use at least occasionally, 7% of clients recall being told.

Germany and Europe

The German-speaking market lags the headline numbers and leads on translation. The Bayerischer AnwaltVerband’s survey of 558 participants, 88% from firms of one to ten staff, found 37.9% of firms using AI; the most-used tools were DeepL (70.7%) and ChatGPT (69.2%); 55% use no cloud software and 42% use none and plan none (Bayerischer AnwaltVerband). legal-tech.de’s 2025 survey (about 80 respondents, half of them sole practitioners) found 16% using a specific AI tool and over 50% using ChatGPT at least sometimes. The European Legal Tech Association’s 2024 study, cited by Anwaltsblatt, found 93% had tried generative AI but only 41% worked with specific tools.

Across Europe, Wolters Kluwer 2026 found 92% using at least one AI tool, with ethics and data-privacy concerns (39%) and inadequate training (39%) as the top barriers. In the UK, LexisNexis found 61% using AI day-to-day by September 2025 (46% in January 2025), and the SRA received 42 reports of potential AI misuse in the year to July 2026. Randomised trials: faster, then better

Two randomised controlled trials have tested law students with AI, and together they tell a before-and-after story. Choi, Monahan and Schwarcz (109 Minn. L. Rev. 147; 60 Minnesota law students, GPT-4) found that access to GPT-4 “only slightly and inconsistently improved the quality of participants’ legal analysis but induced large and consistent increases in speed”, with the lowest-skilled participants gaining most (Minnesota Law Review). Schwarcz and colleagues’ 2025 follow-up with Vincent AI and OpenAI’s o1-preview found productivity gains of 50% to 130% in five of six tasks and significant quality gains; hallucinations numbered three with Vincent AI, four with no AI at all, eleven with o1-preview.

The largest firm-run trial, Ashurst’s Vox PopulAI (411 people, 23 offices), measured about 80% time saved drafting UK corporate filings, and its participants “reported frequent hallucinations across all GenAI tools trialled”.

Methodology notes

Four rules. Never mix a vendor survey (LexisNexis’s 94%), an academic trial (Choi et al.) and a court database (Charlotin) in one sentence without labels. Quote the survey’s own wording: Stanford says “more than 17%”; Thomson Reuters says “almost three in ten” mid-career professionals would leave within two years if AI fails to deliver, not 28%. Date everything, because the series move fast. And prefer the primary page: widely repeated figures such as “300 federal judges have AI standing orders” and “78% of clients want disclosure” do not appear in the sources said to contain them.
